How to Prepare for an FDR or court hearing
How to Prepare for an FDR or court hearing
Going to court as part of your divorce can feel daunting, particularly if you have never experienced the court process before and are unsure what to expect on the day.
In August’s Divorce Support Club webinar, divorce coach Claire Macklin was joined by Walker Family Law solicitor Natasha Alsop to discuss what happens at a Financial Dispute Resolution (FDR) hearing or court hearing, and how you can prepare both practically and emotionally.
Throughout the webinar, Claire and Natasha explored what an FDR is designed to achieve, what happens when you arrive at court, the role of your solicitor or barrister, and what you can expect from the judge.
The webinar covered:
- The purpose of an FDR and how it can help you reach a financial settlement
- What to expect when you arrive at court and why you should allow almost a whole day
- The role of pre-hearing discussions and negotiations before you see the judge
- Why you generally won’t have to sit in the same room as your ex-partner
- The practical arrangements and support available if you have concerns about attending court
- What happens during the formal FDR hearing and the questions the judge may ask
- Why preparation is key, including understanding your court bundle, financial position and priorities
- The importance of knowing where you may be willing to compromise and what your limits are
- How to prepare emotionally and seek appropriate support before the hearing
- What a judge’s indication means and why it is not a final decision
- What happens if you are unable to reach an agreement at the FDR
- Why reaching an agreement can give you greater ownership and agency over the outcome
The key takeaways focused on helping people feel more informed and prepared for what can otherwise be an unfamiliar and intimidating experience. An FDR is an opportunity to understand the judge’s view of your case, negotiate and try to reach an agreement, rather than simply waiting for a judge to decide your future. By understanding what to expect, preparing your financial position and priorities, and having the right support around you, you can approach the day with greater confidence.
